— Hathaway misled consumers into believing he had ordered their new homes when, in fact, he had not completed the ordering process. He failed, in multiple instances, to install homes in a manner that allowed consumers to promptly move in. Hathaway Homes Group has a well-documented history of consumer complaints. Hathaway is no longer involved with Hathaway Homes Group, which is most likely why nobody appeared on behalf of the company.
Advertising or selling new or used manufactured homes from within Idaho, unless he’s properly licensed and works under a state-licensed business entity. — Hathaway failed to pay contractors, who provided contract services to consumers’ homes. When contractors weren’t paid, they filed liens against consumers’ homes. Last week, Fremont County judge Alan C. Stephens granted a default judgment on the state’s complaint against Hathaway Homes Group. During court proceedings, no one appeared on behalf of the company. Therefore, the state requested a default judgment, meaning the court defaults to the plaintiff’s request.

Hathaway. Judgments entered this week in Fremont County District Court restrict Hathaway Homes and Hathaway from doing business in Idaho. Wells Fargo moved to repossess Hathaway’s office in St. Anthony.

— Hathaway also failed to repair — or facilitate the repair of — any damages to consumers’ homes within a reasonable time from the delivery and installation of the home. “Multiple customers never received correct delivery or installation of their homes,” the complaint says. As a matter of policy, BBB does not endorse any product, service or business. To date, the company has not responded to BBB's request to address the pattern. On December 6, 2017, BBB notified the company of the complaint pattern. Complaints allege consumers made a down payment to Hathaway Homes Group to build their manufactured home.
The law firm withdrew as attorney of record in January “based upon the grounds that the defendant and counsel have differing opinions on how to proceed in this matter,” according to court documents. A court trial, which will decide whether Hathaway himself will be banned from Idaho business, is set for the fall. According to an April 2018 court disclosure document, creditors had unsecured claims against Hathaway and his businesses totaling more than $8.2 million. Hathaway, reached by phone, declined to comment on the complaint.

The Attorney General’s Consumer Protection Division started its investigation in early 2017. Hathaway customers reported hundreds of thousands of dollars in losses.
The bankruptcy filing comes after a Utah court issued a $3.8 million judgment against the company. Utah lender TAG Lending LLC brought that case, alleging breach of contract, fraud and other claims. On December 5, 2017, BBB recognized a pattern of complaints from consumers regarding service issues. Public accommodations protections include being unfairly refused services or entry to or from places accessible to the public . Wasden filed a lawsuit against Hathaway Homes and Hathaway under the Idaho Consumer Protection Act in September 2018. Hathaway Homes, which was under the control of a bankruptcy trustee, did not appear in the case, and a default judgment was entered on April 2, 2019.
